Judge William Carey granted the state's request for an expedited hearing in the lawsuit the state faces against Republican Senate candidate Joe Miller.
Miller filed the lawsuit last Monday to stop the Division of Elections from using discretion in determining voter intent on write-in ballots. He has questioned the legitimacy of election returns showing that Sen. Lisa Murkowski won.
Miller claims the system used by the state in tallying write-in votes for Murkowski was not in line with the law and wrongly favored her to win.
Judge Carey acknowledged there is a need to resolve the matter as soon as possible.
The judge is set to hear arguments from both sides next week.
