A state court judge is allowing write-in candidate Sen. Lisa Murkowski to intervene in a legal challenge to Alaska's U.S. Senate race by Republican candidate Joe Miller.

Attorneys for Murkowski argued that she should be allowed to have a voice in the lawsuit that Miller brought against the state over the manner in which it conducted the election. Unofficial results showed Murkowski with a lead, and her attorneys maintained her interests wouldn't be adequately represented by the state.

The attorneys said Murkowski was at odds over the state in its deciding not to count more than 2,000 ballots for her. Many of those did not have the ballot ovals filled but had her name written in.

A hearing in the case is set for Wednesday.
