Robert Luch took the stand in his own defense Monday and told the jury his wife Jocelyn was partially to blame for her own death because she created the melee before Robert shot her.
“My wife was responsible too when she lunged for the gun,” Luch testified, “my wife created the melee.”
Luch said he brought a gun into the bathroom to confront Jocelyn because he thought she had been with another man the night of Sept. 28th 2010, instead of running during the Tuesday Night Races at Kincaid Park.
Luch said he was mimicking Jocelyn’s own behavior because over the years Jocelyn would get mad at him and confront him with a knife.
He also testified that he never pointed the gun at Jocelyn and that he didn’t know if the gun was loaded.
At some points during the day, Defense Attorney Andrew Lambert had Luch shout in the same manner that he had used the summer before Jocelyn’s death when the couple would often argue over Jocelyn seeing another man.
The other man was Bryan Fuqua and he testified Monday morning before Luch.
Fuqua told the jury that Robert once intercepted a phone call between him and Jocelyn.
Fuqua said Robert told him, “I’ll put a bullet in your head,” if he continued to see Jocelyn.
District Attorney Clint Campion questioned Luch about how Jocelyn could be partially responsible for her own death.
“The gunshot wounds were a result of this melee, the melee you say she created?” Campion asked.
“It takes two to create a melee,” Luch said.
“It takes one to bring a gun to the bathroom, right? She didn’t bring a gun to the bathroom,” Campion asked.
“No,” Luch answered.
The prosecution will continue questioning Luch Tuesday with closing arguments expected Wednesday.
