A Superior Court Judge says he will allow Planned Parenthood of the Great Northwest to argue it's entire case in the lawsuit it filed against Alaska over the Parental Notification law.
Judge John Suddock denied the state's motion for a summary judgement, which would have tossed out portions of the case.
The state argued that Planned Parenthood couldn't prove aspects of it's lawsuit.
"Basically the judge agreed with us, that he wanted to hear the case out," Planned Parenthood spokesperson Clover Simon said during a phone interview Saturday morning, the day after the judgement was issued.
The law requires doctors to notify parents if a minor seeks an abortion.
"Every other possible medical procedure and even not medical procedures require parental notification," Jim Minnery, Alaska Family Council President said. "Parents have the right to be involved in any sort of medical procedure."
The case is expected to go to trial in February 2012.
