A federal jury is deciding who is responsible for shooting a 2-year-old boy at the Homer airport in 2006.

The boy, Jason Anderson Jr., was shot in the head and was left brain-damaged. There is disagreement on whether the shot was fired by police or the boy's father, a fugitive from Minnesota who died in the encounter.

The Anchorage Daily News says the boy's mother has sued the city of Homer and its police department for $23 million.  Cherry Dietzmann settled out of court with the U.S. Marshals Service for almost $3.5 million in 2011.

The boy was shot when marshals and Homer police officers tried to arrest Jason K. Anderson, a violent drug dealer who was hiding in Alaska, and fired into his vehicle.
