The Alaska Bar Association Disciplinary Board has recommended the immediate interim suspension of former U.S. Attorney Wev Shea's law license. The board recommend a suspension of 25 months.

The ABA claims Shea had a conflict of interest with a former client, Dr. David Kyzer, when he switched sides to represent Kyzer's sister in a suit between the siblings.

The association wanted its board to disbar Shea or suspend his legal license for also making false statements and unprofessional pleadings to the court.

“Just the fact that the attorney is in possession of this information whether or not the attorney chooses to use it is sufficient to cause a conflict of interest, and in fact it did cause Dr. Kyzer concern. He's in litigation adverse to his sister knowing that his former attorney, who is in possession of confidential information, is assisting his sister,” said the ABA's Louise Driscoll.

Shea says he felt obligated to expose what he considered an ongoing fraud scheme plotted by Kyzer and his attorneys. He claims attorney-client privileges dissolved when his former client broke the law.

Shea also notes that the disciplinary panel dismissed allegations that he revealed confidential information.

“I know that you are wondering probably why Wev Shea would do this. I did it because the conduct is criminal,” he said.

The bar recommended Shea be disbarred or that his license be suspended for four to five years. It also recommends Shea have a mental evaluation.

The Supreme Court will make the ultimate decision on the suspension, and could still disbar Shea.
